These Terms of Service ("Terms") govern your access to and use of the Elevation platform at getelevation.io (the "Service"), operated by MomentumEQ Labs, Inc. ("MomentumEQ," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To use the Service, you must create an account using a valid email address or a supported OAuth provider (Google, Microsoft, or WebEx). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Access to the Service may require administrator approval. We reserve the right to approve, deny, or revoke access to accounts at our discretion.

You retain ownership of all data you submit to the Service, including building profiles, assessment responses, uploaded documents, and calculator inputs ("Your Data"). You grant us a limited license to store, process, and display Your Data solely to provide and improve the Service.
You are responsible for the accuracy and legality of Your Data. You represent that you have all necessary rights and permissions to submit Your Data to the Service.
The Service allows you to share assessments with other users at specified permission levels (view, comment, or edit). You are responsible for managing who has access to your assessments. We are not responsible for how recipients use shared data.
Certain features of the Service use large language models (LLMs) to generate content, including assessment questions, strategic recommendations, and document analysis. AI-generated content is provided for informational purposes only and should not be relied upon as professional engineering, architectural, or legal advice.
You acknowledge that AI-generated content may contain inaccuracies. The deterministic scoring engine, gap analysis, and prescriptive recommendations are rules-based and do not use AI, but the strategic recommendations and question generation features do.
The Service, including its design, code, scoring methodology, question bank, ecosystem catalog, and documentation, is owned by MomentumEQ Labs, Inc. and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets.
Assessment reports and exports generated by the Service from Your Data are yours to use for your business purposes.
The Service integrates with third-party services including authentication providers (Google, Microsoft, WebEx), data APIs (Electricity Maps, EIA, BLS, NREL, OpenEI, WattTime), and AI providers (OpenRouter). Your use of these third-party services is subject to their respective terms and privacy policies.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTUMEQ LABS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Maturity scores, gap analyses, recommendations, and calculator results are decision-support tools. They do not constitute professional engineering, architectural, or construction advice. You are responsible for validating all outputs with qualified professionals before making investment or design decisions.
You agree to indemnify and hold harmless MomentumEQ Labs, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your access to the Service at any time, with or without cause, upon notice to you. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain Your Data for a reasonable period to comply with legal obligations.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
